What are Checks and Balances? These are one of the fundamentals on which
our nation was founded. If there is one controlling entity in our nation, we
would call it a dictatorship. If there were two controlling entities, we
would have many stalemates in the construction of our government. Instead,
three entities were created to counterbalance a stalemate without letting
one single entity gain sovereignty over our nation. These entities are the
Legislative, Executive and Judicial branches.
The Legislative branch provides that Congress, composed of the Senate and
The House Of Representatives, has the power to create and/or pass a bill.
The Legislative branch also approves court appointments to the Judicial
branch made by the Executive branch.
The Executive branch is the second of the three branches empowered by The
Constitution. The Constitution also provides that the President will be the
head of the Executive branch. The Executive branch may veto acts of congress
or delay the execution of congressional acts. This branch also nominates our
federal justices for the Supreme Court and has the power to delay the
enforcement of judicial decrees.
The Judicial branch is our last, and by no means least important branch. It
rules on the constitutionality of acts initiated by the Executive and
Legislative branches.
In short, each branch checks the others respectively and keeps things
balanced by never putting too much power in one office. Putting all your
eggs in one basket is definitely a no-no. Never know when there's a bad one
in the bunch.
Now, let's tip the scales of Justice here just a wee bit. We have an office,
created by the President, called FEMA or [F]EMA. The Acronym stands for
Federal Emergency Management Agency. This office answers solely to the
President and has all kinds of neat little features. In the event of
national crisis, FEMA will have the power to suspend the Constitution and
The Bill of Rights. Now, I don't know about you, but this sort of sounds
like
a loophole to me. FEMA also has the power, if such an event should occur,
to eliminate private property (that means they want the land you've bled and
sweat for) and abolish free enterprise (in general terms, if you own a
business like gunsmithing or farming, you'll then be working directly for
the federal government). Hmmm. Now, what would a national crisis entail?
Guess what? The President has the power to declare a national crisis.
Okay, here's a theory for you: The President declares a national crisis for
whatever reason he may. This empowers FEMA (remember, this office was
created
by the President and answers only to the President) to suspend the
Constitution. That would also suspend the activities of our three branch
system. When the Constitution is no longer active, who leads the country?
FEMA? We already know that the President officiates duties as its leader,
right? So, if we should be in a state of national crisis, who would make
our laws then? Starting to sound a bit like someone dropped a lead weight on
the scale of justice here.
Would you blame certain states for wanting to secede from the Union? Would
you want to live in the claws of a dictatorship? Something awfully stinky
happens to our system of checks and balances when it's possible for one
power to aggressively freeze its counterparts... Just something to think
about...
